General conditions of sale
It is stated that:
SARL La Sanglière is a limited liability company with a capital of 8,000 euros, whose principal establishment is located at 3886 Route de Léoube, 83230 Bormes les Mimosas, registered in the Toulon trade and companies register under number 441 196 4954, represented by Mr. Rémy DEVICTOR and Mr. Olivier DEVICTOR, duly authorized legal managers (hereinafter defined as “La Sanglière”, in accordance with the trademark LA SANGLIERE registered by SARL La Sanglière).
La Sanglière operates, from France, a free online sales platform allowing individual buyers, adults acting as consumers, to purchase wine products and to search for and book wine tourism services online.
La Sanglière is the producer of the wine products available online and the wine tourism activities on sale on the Site.
It was therefore agreed and decided as follows:
Definitions
For the proper understanding of these terms, the Parties agree to the following definitions:
“Buyer”: means a natural person of full age acting as a consumer, having placed an order through the Site Services to acquire Products.
“Seller”: means La Sanglière, a professional wishing to offer its wines and wine tourism activities for sale.
“User”: means users of the Site and its Services without distinguishing whether they are Sellers or Buyers.
“Product”: means the wine product in the form of a bottle of wine through the Services offered by La Sanglière. Several bottles of wine will be referred to as “the Products”.
“Service”: means the Seller’s wine tourism activity available for booking in the form of tours and tastings. Several tours and tastings will be referred to as “the Services”.
“Product Sheet”: means the presentation of the essential characteristics and in particular the price of a Product offered for sale by the Seller on the Site.
Article 1. Purpose – Scope of application – Membership
The Site is available in French and English.
Access to and use of the Site and the Services on this Site are subject to the terms and conditions of these general terms and conditions of sale (hereinafter the "GTC"). By using the Services and the Site, Users accept the GTC as well as the regular updates by La Sanglière. The GTC apply to all sales of Products or Services made by La Sanglière and its Services and are intended to govern the relations between La Sanglière and the Users as well as between the Users.
The General Terms and Conditions are subject to change at any time; those applicable are those in force on the day the order is placed by the Buyer.
The General Terms and Conditions are automatically accessible to Internet users from the home page of the Site. The Internet user simply has to click on the “General Terms and Conditions of Sale” section. Users of the Site are advised to consult this page regularly.
Article 2. Product Sheet
The Products and Services are presented on the Site by means of a Product Sheet with a description enabling the Buyer to know their essential characteristics and their Price.
The information relating to the offers has been communicated by the Sellers, the latter being solely responsible for the content of the description provided, its completeness and the conformity of the Products and Services offered to the description.
The photos and visuals of the Products and Services are provided for illustrative purposes and are not contractual.
Article 3. Conclusion of the contract
The La Sangliére website provides all the information required by article L.121-19 of the Consumer Code.
3.1. Order process on the Site and order confirmation
a. Buyers may order the Products offered by the Seller on the Site as long as the Product offers materialized by the Product Sheets are visible on the Site.
If the Buyer has a valid discount code, he/she must simply enter the code in the box provided for this purpose before finalizing his/her order.
After having been able to check and modify the content and price of his order, and to be able to finalize his order and pay, the Buyer declares having read and fully and unreservedly accepted all of the General Terms and Conditions, by clicking on the box "I accept the general terms and conditions of sale".
The language proposed for the conclusion of the contract is French.
b. An order confirmation email is then automatically sent to the Buyer (this email includes all the information required by Article L. 121-19 of the Consumer Code).
However, the sales contract is subject (i) to the resolutory condition that the Product is available (see article 3.2 below) and (ii) that La Sanglière has acknowledged receipt of payment.
An order is deemed confirmed when La Sanglière is able to confirm that payment has been received.
3.2. Availability of the Product(s) – Resolutory condition
The sales contract is subject to the condition that the Products are available and that La Sanglière has acknowledged receipt of payment.
In the event that (i) the same Product is the subject of an order by several Buyers at the same time and (ii) this Product is no longer available in sufficient quantity to satisfy all the orders, it will be sold in the chronological order of the orders placed by the Buyers according to the principle of “First come, first served”.
In the event of unavailability of the Product(s) after placing the order, the Buyer will be notified by email sent by La Sanglière within forty-eight (48) working hours. The Buyer will then be offered a similar Product by La Sanglière or will be able to be reimbursed for the amount debited, according to his choice. In the second case, the contract concluded between the Buyer and the Seller will then be automatically terminated and each party will be released from its obligations. The Buyer's bank account will be credited with the amount of the cancelled order within fifteen (15) days. However, only the contract relating to the sale of the unavailable Product(s) is affected by this termination.
It is recalled that only the Seller has control over the availability of the Product. The sales contract is deemed concluded at that time.
3.3. Search and book a wine tourism service online
It is the User's responsibility to make all checks that seem necessary or appropriate before making any reservation on the La Sanglière website. The User undertakes to check the conditions of validity of the requested service, in particular the minimum and maximum number of people who can access such a service.
Article 4. Prices and payment terms
4.1. Selling Price for Bottle Purchases
The Price is indicated on the Site in euros, all taxes included, delivery costs not included.
4.2. Sales price for wine tourism services
La Sanglière offers a wine tourism activity booking service. Following a booking made through the La Sanglière website, the Buyer agrees to pay the amount indicated. The Price is indicated on the Website in euros, all taxes included.
4.3. Payment terms
Payment of the Price of the Product(s) and delivery costs is made when ordering on the Site from La Sanglière, and in the case of Article 4.1.b, after express acceptance of the terms and transport costs by the Buyer.
Payment can be made in 1 way:
1) by credit card: The Buyer will be debited for the price of the Products purchased from the moment he has validated and confirmed his order online. In the event of non-receipt of payment by La Sanglière within forty-eight hours (48h) from the order date, the sales contract is automatically terminated (see article 3.1.b). Each party is therefore released from its obligations.
The Buyer will therefore provide accurate, complete and non-fraudulent data when paying for the order. The Buyer declares and guarantees that he is fully capable and authorized to use the bank card and that he has sufficient funds, in the bank account linked to the bank card used, for the payment of his order.
La Sanglière, with the services of the financial institution Stripe, may be required to carry out checks to ensure the validity of payments and therefore request certain supporting documents from the Buyer, which the latter undertakes to send within forty-eight (48) hours. In the event of non-receipt of these documents within the expected time frame or receipt of non-compliant documents, La Sanglière reserves the right to cancel the order(s).
A detailed invoice by Les Grappes is made available on the Buyer's account and sent to the Buyer at the time of shipment of the package.
4.4. Payment security
Payment is made online using a secure SSL payment system. The site guarantees that all banking data required for the banking transaction and payment benefit from a secure encoding and encryption system. The highest security standards are applied to data storage and are all compliant with the Payment Card Industry Date Security Standard (PCI DSS). No banking information is stored by the site. All payments are secured through Stripe.
La Sanglière has adopted the most efficient security systems to date, which establish an encrypted connection directly between the Buyer and the bank. La Sanglière uses the Stripe solution using the SSL (Secure Socket Layer) encryption process but reserves the right to change the system at any time.
The site guarantees that all banking data required for banking transactions and payments benefit from a secure encoding and encryption system. The highest security standards are applied to data storage and are all compliant with the Payment Card Industry Date Security Standard (PCI DSS). No banking information is stored by the site.
Although La Sanglière uses encrypted security software, the security of information and payments transmitted over the Internet or via e-mail cannot be guaranteed. Les Grappes cannot be held responsible for damages resulting from the use of electronic means of communication.
Article 5. Shipping and Delivery
5.1. Delivery of the Product(s) is currently available in mainland France.
5.2. Delivery costs are invoiced to the Buyer at the rate in effect when the order is placed.
5.3. As soon as the payment according to the terms defined in article 4 is credited to La Sanglière's account, the Seller has validated the availability of the Product(s) (in accordance with articles 3.1.b and 3.2.), and has packaged them, the Product(s) is (are) handed over to the Carrier within forty-eight (48) hours. The Seller will use packaging suitable for the delivery of its Product.
The Seller will ensure that the information communicated to the Carrier is correct and allows rapid delivery of its order to the Buyer.
5.4. Deliveries are made within fifteen (15) working days maximum from order confirmation (see article 3.1), except in cases of force majeure.
The times indicated correspond to the processing, preparation and shipping times of orders, as well as the delivery time of the Transport Service Provider.
5.5. The Products are delivered to the delivery address indicated by the Buyer when ordering.
In the event of an incomplete or incorrect delivery address or failure to collect the package, forcing the Carrier to return the Product(s) ordered, any additional costs incurred as a result of this failure or error will be borne in full by the Buyer. The order will only be reshipped after the Buyer has paid the reshipping costs.
5.6. Verification of goods upon delivery
Verification of the condition of the package and the Products is effective once the Carrier's delivery note has been signed by the Buyer.
Any deterioration, non-conformity or shortage upon delivery must be notified by the Buyer to the Carrier in the form of a detailed and dated document accompanied by the Buyer's signature on the delivery note.
If the Buyer refuses the package due to an anomaly or non-conformity, the Buyer must notify this on the Carrier's proof of delivery. Three mentions are possible:
1. Fully compliant
2. Acceptance of part of the goods with reservations
3. Refusal of the goods with reservations
Failure to issue reservations will render any claim inadmissible a posteriori.
If damage is found during a purchase, French law provides that the Buyer has a period of fourteen (14) days after delivery to issue reservations to the Sender and the Recipient, and releases the Carrier from any liability beyond this date (in accordance with Article 31 of the Montreal Convention). If a delivery failure is found, the Buyer has 72 hours to give instructions to La Sanglière. If no instructions are given, the goods are returned to the estate within 96 hours at the Buyer's expense. The order will only be reshipped with a new order from the Buyer. In the event that no notification or reservation has been entered on the Carrier's waybill, the Buyer may not under any circumstances make a claim to La Sangliére.
5.7 Checking the goods after delivery
The Buyer has 14 days to make a complaint if the goods do not conform to their order or if the organoleptic properties of the product do not appear to meet their expectations.
Article 6. Right of withdrawal
6.1. In accordance with the legal provisions in force, in the context of a purchase made from a Seller, the Buyer has a period of fourteen (14) days from receipt of the Product(s) ordered to exercise his right of withdrawal with La Sanglière, without having to provide reasons or pay a penalty.
The Buyer exercises his right of withdrawal directly with La Sanglière by e-mail to commercial@domaine-sangliere.com, indicating his order number and the references of the Product(s) for which he exercises his right of withdrawal.
6.2. In the event of exercising the right of withdrawal within the aforementioned period, only the Price of the Product(s) purchased and for which the right of withdrawal is exercised by the Buyer will be reimbursed by La Sanglière, the return costs remaining the responsibility of the Buyer.
In the event of a refund request, La Sanglière will refund the Product(s) by crediting the Buyer's bank account within a maximum period of thirty (30) days following the date on which the right of withdrawal was exercised.
6.3. The order must be returned in perfect condition to the Seller, in its original packaging or in suitable packaging and in a condition suitable for the re-marketing of the Product(s) (unopened bottles, undamaged caps and labels, etc.), accompanied by the invoice and then shipped in the same conditions as those in which it was sent.
The Buyer has fifteen (15) days from the moment he/she has informed La Sanglière of his/her withdrawal to return the package. The return costs are the responsibility of the Buyer. It is up to the Buyer who returns one or more Products to keep proof of the reshipment of the Products by him/herself. This proof will be provided either by presenting a registered mail receipt or by presenting a document provided by a Carrier to whom the delivery of the returned Product has been entrusted.
Article 7. Complaints
7.1. In general, La Sanglière undertakes to provide a quality service to Users.
In this respect, any Buyer has the possibility of reporting by sending an e-mail to La Sanglière at the address commercial@domaine-sangliere.com, within seven (7) days of receipt of any order, any complaint concerning the Products ordered, according to the following criteria:
– Product not received: the Product has not been received by the Buyer.
– Non-compliant product: the Product received does not correspond to the Product ordered.
– Damaged Product: the Product received is damaged or broken.
7.2. In the event of a complaint from a Buyer concerning a Product. The Seller will implement all means at its disposal to manage the incidents mentioned above. Disputes are therefore settled between the Buyer and La Sanglière who will make their best efforts to resolve disputes amicably.
7.3. Depending on the case, the declared dispute will give rise either to the return of the Products ordered or to a partial or total refund of the Buyer. This refund is made by La Sanglière.
7.4. The Buyer will be responsible for organizing the return of the Products to the Seller.
Article 8. Personal data and CNIL
8.1. Processing of personal data
The Data communicated by the User as part of an order (name, first name, e-mail, address, telephone number, etc.) via the Site are intended for La Sanglière and are used for processing and monitoring orders, customer relations and to meet the legal and regulatory obligations incumbent on La Sanglière.
With regard to data relating to the Seller's Products ordered by Buyers, which are collected within the framework of the Site and its Services, La Sanglière informs Buyers that they are intended for La Sanglière, and that only the information necessary for the delivery of the Products will be transferred, for this sole purpose, to the Seller. They may not under any circumstances be used for other purposes.
The Seller will ensure the security of the Buyers' Data that it keeps for the purposes of fulfilling and monitoring orders.
As part of the T&Cs, Users may receive information relating to the Site and the Services by email from La Sanglière.
In accordance with the provisions of Law No. 78-17 of January 6, 1978, the Site has been declared to the National Commission for Information Technology and Civil Liberties, under number 1741000v0.
The User has the right to access, modify, delete and rectify their personal data by sending an email to commercial@domaine-sangliere.com or by post to La Sanglière 3886 Route de Léoube, 83230 Bormes les Mimosas.
8.2. Cookies
In order to allow the User to avoid having to identify themselves each time they access the Service during the same day, except during the first access, La Sanglière uses session cookies.
These files placed on the computer make it possible to identify the User each time they connect to the Site.
Furthermore, in order to improve the Site, La Sanglière uses audience measurement cookies such as the number of pages viewed, the number of visits, the activity of visitors on the Site and their frequency of return thanks to the services of AT Internet and Google Analytics. These cookies only allow the establishment of statistical studies on the traffic of visitors to the Site, the results of which are completely anonymous.
La Sanglière also uses third-party cookies. Third parties authorized to access the data collected in these third-party cookies by La Sanglière Company undertake to use this data in accordance with the provisions of the Data Protection Act of 6 January 1978, amended by the Act of 6 August 2004, and to respect the privacy of Internet users.
The User can access all the information contained in the files relating to the cookies used by Sangliere in accordance with the provisions of the “Informatique et Libertés” law of January 6, 1978, by sending the request:

In general, any User may, if they wish, oppose the use of cookies used by La Sanglière Company by selecting the appropriate settings in their browser to deactivate cookies (the help section of the browser used specifies the procedure to follow).
Article 9. Relationship with Users

Article 10. Discount Codes
A non-exchangeable, non-refundable and non-transferable Discount Code placed in the Buyer's Cart.
The Buyer can use a Discount Code to pay for his order:
If the amount of the Discount Code used is greater than the amount of the order, Sangliere cannot give change;
If the amount of the Discount Code used is less than the amount of the order, the Buyer must pay the difference.
A Buyer can obtain a Discount Code:
In the case of a commercial gesture on the part of La Sanglière. The discount code obtained is valid for one (1) year from its date of creation.
As part of promotional operations organized by La Sanglière.
In the case of Refund of a Product purchased with a Discount Code. The Buyer then receives a new Discount Code valid for one year (1).
Article 11. Guarantees
The Products offered on the Site through its Services are covered by French legal guarantees. In accordance with the legal provisions in force relating to the conformity of the goods or hidden defects, defective Products or those not corresponding to the order will be refunded.
These guarantees are without prejudice to the right of withdrawal provided for in Article 6 hereof.
Article 12. Intellectual Property Rights
The intellectual property rights relating to the trademarks, software and content made available to Users on or through the Site and its Services remain the property of La Sanglière and its potential licensors and are protected by the applicable laws and regulations in this area. Consequently, it is prohibited to reproduce, represent or modify the software or content of the Site and the Services by any User for commercial or professional purposes.
Article 13. Sale of alcoholic beverages – Minors – Legal capacity
In accordance with Article L. 3342-1 of the Public Health Code, the sale of alcoholic beverages to minors is prohibited.
All offers on the Site are therefore reserved for adults aged eighteen (18) or over, with legal capacity.
By placing an order, the User or Buyer declares and guarantees that they are of legal age and have full legal capacity to enter into a sales contract with La Sanglière.
It is also recalled that alcohol abuse is dangerous for your health and that alcohol should be consumed in moderation. For information tailored to the health of each Internet user, La Sanglière advises them to contact their doctor.
Article 14. General provisions
14.1. Registers
The computerized records, stored in La Sangliére's computer systems, under reasonable security conditions, will be considered as proof of communications, orders and payments made in application of the T&Cs.
14.2. Limitation of Liability
La Sanglière is only bound by an obligation of means concerning the information and in particular the photos appearing on the Site and in particular on the Product Sheets. They are provided without condition or guarantee that they are accurate, complete and up to date.
Unless otherwise provided, and to the extent permitted by French law, La Sanglière expressly excludes any liability for any damages, including, without limitation, any direct, indirect, special, consequential or incidental damages, or damages relating to loss of use, profits, data or other intangible property, damage to goodwill or reputation, or the cost of procurement of substitute products or services arising out of or in connection with the use, inability to use, performance or malfunctions of the Site and the elements posted on it, regardless of whether such damages could be considered foreseeable under contract, tort, case law or any other applicable body of law.
This provision does not affect La Sanglière's liability for death or personal injury resulting from its negligence, or its liability for fraudulent misrepresentation, misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited by law.
Consulting and placing an order on the Internet implies knowledge and acceptance of the characteristics and risks associated with the Internet, in terms of technical performance, response times, risks of interruption, viruses and more generally all risks associated with the connection and transmission of data on the Internet. The Internet user must take all appropriate measures to protect his own data and information stored on his computer equipment. The creation of hypertext links to the Site is subject to the prior agreement of La Sanglière. Hypertext links established towards other sites from the Site may not, under any circumstances, engage the responsibility of La Sanglière.
14.3. Nullity of a clause
Any clause of the T&Cs that is declared null and void pursuant to a law, regulation or final decision of a competent court shall be ineffective, but its nullity shall not affect the other stipulations or affect the validity of the T&Cs. As far as possible, in the event that a clause/sub-clause or part of a clause/sub-clause can be separated from the rest of the clause in order to make the remaining part valid, the clause must be interpreted accordingly. Otherwise, the User accepts that the clause in question shall be rectified and interpreted in such a way that it approximates the original meaning of the clause, in accordance with the law.
14.4. Disputes and Applicable Law
The General Terms and Conditions are governed by French law. Any dispute relating thereto which is not initially resolved amicably, in particular in accordance with Article 7.3, will be submitted to the competent French courts.
